National Context

State of National Emergency: The Executive Branch, through Supreme Decree No. 041-2022-PCM of April 23, 2022, extended the state of national emergency, for a period of thirty-one calendar days, as of May 1, 2022. , due to the serious circumstances that affect people's lives as a result of COVID-19.

Likewise, those over 18 years of age who wish to enter closed spaces must present their physical or virtual card that certifies having completed their vaccination against COVID-19, in addition to wearing a mask permanently.

The verification of the physical or virtual card that certifies compliance with the complete vaccination schedule and the booster dose in Peru and/or abroad, must be carried out together with an official identity document.


Curfew: Through Supreme Decree No. 010-2022 PCM , the Government officially suspended curfews or social immobilization. The measure is valid from Monday, January 31. In addition, restrictions continue to protect people's lives, such as banning gatherings and reducing capacity at social gatherings.


    State of Sanitary Emergency: By Supreme Decree No. 003-2022-SA , the State of Sanitary Emergency is again extended for an additional 180 calendar days, starting on March 2, 2022. This extension allows the generation of measures aimed at guaranteeing the public service of health in cases.

    Measures against COVID

    General measures in accordance with Supreme Decree No. 041-2022-PCM :

    • Respect physical distance, not less than 1 meter, between people.
    • Prioritize activities within your own family nucleus.
    • Frequently wash your hands.
    • Wear a mask or double mask in closed spaces and to travel on public roads. Only in Ancash, Ica, Metropolitan Lima, Lima provinces and Callao , its use in open spaces is optional .
    • Avoid crowds.

    In addition, public and private entities must:

    • Have your premises properly ventilated, with doors and windows open, when possible.
    • Prioritize remote work and staggered hours for staff entry and exit.

    Entrance to closed premises

    • If you are over 18 years of age and need to enter a place where people gather (shopping centers, galleries, supermarkets, markets, restaurants and the like in internal areas, casinos, etc.), you must present your physical or virtual card that proves having received , in Peru or abroad, the 3 doses of the vaccine against COVID-19.

    By Official Letter OF.RE (DGC) No. 2-10-E/1081, the General Director of Peruvian Communities Abroad and Consular Affairs of the Ministry of Foreign Affairs informs MIGRACIONES that, within the framework of the Ushuaia Protocol and the Fourth Axis of the National Migratory Policy, it corresponds to admit Venezuelan nationals who, for humanitarian reasons, need to enter the national territory with an identity card and without a passport, the beneficiaries of this decision being the following people:
    (i) minors in transit to Peru to reunite with their parents and do not have an identity card or passport but only a birth certificate, (ii) adults in transit to Peru to reunite with their family nucleus residing in Peru, (iii) adults in a situation of extreme vulnerability in transit to Peru, (iv) pregnant women in a situation of extreme vulnerability in transit to Peru; and, (v) older adults , over 60 years of age, in transit to Peru.

    In order to travel to Peru, all people must previously fill out the Sworn Declaration of Health (https://e-notificacion.migraciones.gob.pe/dj-salud​/) within 72 hours prior to the trip. The registration is individual and in the case of a minor, it is carried out by the guardian or person in charge of the traveler.

    Peruvians, resident foreigners, and non-resident foreigners 12 years of age or older must prove (by showing the physical or digital certificate) that they have completed the vaccination schedule against COVID-19 (two doses or the Janssen monodose) in the Peru or abroad. Otherwise, a negative molecular test (PCR) can be presented with a result date that is not more than 48 hours before the time of shipment at its point of origin.

    Children under 12 years of age only need to be asymptomatic at the time of boarding.

    • If you are Peruvian, a resident foreigner, or a non-resident foreigner 12 years of age or older, regardless of the country you come from, you must prove that you have 2 doses of your COVID-19 vaccine , or failing that, you must present a negative molecular test with a result date no later than 48 hours before boarding at your place of origin ( Supreme Decree No. 016-2022-PCM ).
    • If you are over 18, you must have all 3 doses.
    • In the case of children under 12 years of age, they only need to be asymptomatic to board.
    • The use of a double mask is mandatory.
    • You must complete the Affidavit of Health and Geolocation Authorization , choosing the type of trip within 72 hours prior to it, and submit it virtually. If you are a minor or a dependent person, this record must be completed by your legal representative or person in charge.
    • You may be required to download an application to complete your registration, however, this requirement is not mandatory and you may choose other means to do so.

    Upon arrival in Peru , you must go through a temperature measurement chamber and, if you present any signs or symptoms compatible with COVID-19, you will be evaluated by the doctor on duty in the COVID-19 module. If necessary, the transfer to the health services or place where you will complete the isolation will be in charge of the Minsa.

    In the Affidavit, you must put the address and telephone number of the place where you will be staying while you are in isolation for 14 days. The Minsa will call you every 3 days to monitor your health status. After 14 days, monitoring ends.

    If you need to finish the quarantine before completing the 14 days , you must pay and undergo an additional molecular test to rule out COVID-19 on the sixth day of your arrival in the country. If your result is negative, the health authority will grant you an epidemiological discharge. Otherwise, you will enter mandatory isolation in the Villa Panamericana or another temporary isolation center in coordination with the health authority.

    Every person has the right to free access to health benefits according to the General Health Law (Art. 1). Migrants, regardless of their immigration status, can access medical care in public and private establishments.     It can be requested by foreigners who are in Peru, and who correspond to the nationalities that are members of the Mercosur International Agreement. (Brazil, Colombia, Ecuador, Bolivia, Chile, Argentina, Uruguay and Paraguay).

    Applicants who do not file a permanent residence procedure with the National Immigration Superintendence after the expiration of their temporary residence (two years) will be subject to Peruvian immigration legislation.

    About permanent residence :

    • Purpose: to obtain an indefinite residence, by virtue of what is established in the Mercosur International Agreement.
    • It allows: to work, study, open bank accounts, access health services, create a company, obtain the single taxpayer registry (RUC), request a driver's license, access social programs and services, among others.

    Requirements:

    1. Immigration Status Change Form .
    2. Payment receipt for S/. 162.50 to code 07568
    3. Simple copy of the current passport or identity card or certificate of nationality.
    4. Sworn statement not to record judicial and/or criminal and/or police records in Peru.
    5. Prove that there are lawful livelihoods that allow the subsistence of the petitioner and his cohabiting family group.

    Important:

    • The procedure is personal and does not admit the intervention of a proxy.
    • The application must be submitted within 90 days prior to the expiration of the temporary residence.
    • It is necessary to have current temporary residence, obtained in accordance with the terms of the Mercosur agreement, at the time of submitting the application.
    • In the case of minors, they must appear in the company of their father, mother or guardian, and present the requirements stipulated in article 56-C of the Regulation of Legislative Decree No. 1350/2017 .

    • Birth certificate (in case of being a minor) or verification of the person's marital status and nationalization or naturalization certificate, when applicable
    • Certificate of not registering judicial and/or criminal and/or police records in the country of origin or in which you have resided during the five (05) years prior to your arrival in Peru.
    • Sworn statement not to record criminal, judicial and police records at the international level or alerts registered in the INTERPOL system.

    Important:

    The procedure is personal and does not admit the intervention of a proxy.

    In the case of minors, they must appear in person accompanied by their father, mother or guardian, submit a sworn declaration of conformity and submit the requirements stipulated in article 56-C of the Regulations of Legislative Decree No. 1350 and amendments.

    These are the steps you must follow:

    • Request a Temporary Stay Permit Card (CPP), a document issued by the National Immigration Service, valid for 1 year, non-renewable.
    • And before your CPP expires, you must choose one of the immigration statuses established in current immigration regulations.

    Once you have the regularization, you can request your change of migratory status by Mercosur Agreement through the digital agency of the National Superintendence of Migration.

    An irregular migratory situation is understood when:

    • the foreign person has expired the period of permanence corresponding to the Immigration Status assigned by the Immigration Authority and remains in the national territory.
    • when the foreigner has entered the national territory without having carried out immigration control.

    In both cases, the Regulations of the New Migration Law stipulate a regularization process; however, this does not happen indiscriminately or as a common practice. The regulations must be understood when the foreign person is in a situation of vulnerability or proven extreme vulnerability; in these cases, you must start the process with the Vulnerability Office of the central headquarters or by means of a written request in the decentralized zonal offices.

    Any foreign person who wishes to regularize their situation in Peru may obtain a foreigner's card requesting residence due to a change in immigration status.

    This is the document that accredits the foreign person as a resident of Peru and is valid for 4 years if the person is of legal age, while for minors it lasts 3 years. In the Permanent Immigration Status, the validity can last 5 years.

    Conditions

    • Being a foreign citizen with Immigration Status of Resident.
    • Being in national territory.

    It is necessary to make the payment of S/ 49.90 to the Banco de la Nación for your right to manage the procedure.

    Once you have the Immigration Status of Resident and after payment of S/ 49.90 to the Banco de la Nación or on the payment platform , you must request your registration in the Central Registry of Immigration to the National Superintendence of Migration , virtually.     The Immigration Status of Residence authorizes temporary residence in the territory of the Republic. There are different types of immigration status, which are the following:

    1. Resident worker

    • Purpose: Obtain residence with Migratory Status of Worker for three hundred and sixty-five (365) days, to carry out lucrative activities in a subordinate or independent manner.
    • It allows: to work, study, open bank accounts, access health services, create a company, obtain the single taxpayer registry (RUC), request a driver's license, access social programs and services, among others.

    Requirements

    • Form (free) that can be obtained on the website www.migraciones.gob.pe or at the National Migration Superintendence – MIGRATIONS.
    • Payment receipt for S/. 162.50 to code 07568.
    • Simple copy of the current passport or valid analogous travel document, when the latter is recognized by Peru as a travel document.
    • International Exchange Card issued by the OCN INTERPOL - Lima of the National Police of Peru with an issue date of no more than six months.
    • Document issued by a competent authority that proves not to record judicial, criminal and police records in the country of origin or in which the applicant would have resided for the period of five years prior to his arrival in the national territory.
    • Sworn statement of the legal representative of the contracting party, stating their names and surnames. Likewise, in the event that the person signing the contract has a position other than that of General Manager, indicate the entry number and registration entry where it is specified that they have the power to hire personnel.

    In the case of Dependent Worker:

    • Simple copy of the employment contract, dated no more than thirty (30) calendar days after the issuance of the current document approved by the administrative labor authority, except for the exceptions provided by Law, specifying the term of the contract equal to or greater than ( 1 year.
    • In case of administrative relationship, present the current employment contract in a simple copy that specifies the term of the contract equal to or greater than one year. In case this does not imply the conclusion of an employment contract, you must present a simple copy of the administrative resolution that proves the employment relationship, specifying the work term equal to or greater than one (1) year.

    For the case of Independent Worker

    • Simple copy of the contract for the provision of services, indicating the duration of the service equal to or greater than one (1) year.

    Important:

    • The procedure is personal and does not admit the intervention of a proxy.
    • In the case of a worker, if the contract has been signed in the national territory, the beneficiary must meet the migratory status enabled or have the authorization to sign documents. Likewise, the presentation of the contract must be no older than thirty business days after being approved by the labor authority, the latter case does not apply to independent workers.
    • In the event that the contract contemplates trial periods or the term is less than one (1) year, its evaluation corresponds as an administrative procedure for the application of Temporary Worker migratory status.
    • The contracting entity must be active and registered with the National Superintendence of Customs and Tax Administration - SUNAT.

    2. Resident training

    • Purpose: to obtain a residence with Immigration Quality of Training, granting a period of permanence of 365 days, in order to develop regular studies of basic, higher education, arts or trades, in institutions recognized by the Peruvian State.
    • It allows: studying, opening bank accounts, accessing health services, requesting a driving license.

    Requirements:

    • Form (free) that can be obtained on the website www.migraciones.gob.pe or at the National Migration Superintendence – MIGRATIONS.
    • Payment receipt for S/. 162.50 to code 07568.
    • Simple copy of the valid passport or valid analogous travel document.
    • Judicial, criminal and police records of the country of origin (Only adults).
    • Interpol Exchange Form (Only adults).
    • Simple copy of the document that certifies the respective training modality, not older than thirty calendar days.
    • Sworn statement of economic solvency of the applicant for the duration of the migratory status.

    • Copy authenticated by notary of MIGRACIONES, of the judgment or judicial resolution or analogous public instrument that assigns parental authority over the minor, taking into account the suspension or termination of parental authority established with respect to the other parent.
    • Copy authenticated by notary of MIGRATION of the departure or death certificate of the other parent in the event that it is registered before a foreign authority; if it is registered in the RENIEC civil registries, a simple copy of the death certificate is presented.

    2. Resident relative

    • Purpose: Maintain proven family ties with nationals or with foreign residents with current residence in Peru.
    • It allows: to work, study, open bank accounts, access health services, create a company, obtain the single taxpayer registry (RUC), request a driver's license, access social programs and services, among others.

    Requirements:

    • Form (free) that can be obtained on the website www.migraciones.gob.pe or at the National Migration Superintendence – MIGRATIONS.
    • Payment receipt for S/. 162.50 to code 07568.
    • Simple copy of the valid passport or valid analogous travel document.
    • Judicial, criminal and police records of the country of origin.
    • Interpol Exchange Sheet (only adults)

    Specific cases:

    • In the case of married to a Peruvian or resident foreigner: Marriage certificate
    • In the case of minor children of a Peruvian or resident foreigner: Birth certificate, DNI or Immigration Card of the resident family member
    • In the case of sons and daughters over 18 years of age with disabilities: Birth certificate Document proving the condition of permanent disability, DNI or Immigration Card of the resident family member and Notarized affidavit of singleness.
    • In the case of unmarried children over 18 years of age and under 28 years of age: Birth certificate DNI or Immigration Card of the resident family member; Affidavit of singleness legalized by a notary and Proof of studies or enrollment from the study center with official state recognition
    • In the case of parents of Peruvians or resident foreigners: DNI or immigration card of the resident child and birth certificate of the resident child.

    In the case of Minors

    • By both parents, if both have recognized the minor and are alive
    • For only one of the parents, in this case, one of the following documents must also be presented:
    • Copy authenticated by a notary of MIGRACIONES, of the power granted by the other parent to act on his or her behalf.
    • Copy authenticated by a notary of MIGRACIONES of the judicial sentence or resolution of judicial Migrations or analogous public instrument that assigns only to this the parental authority with respect to the minor, taking into account the suspension or termination of the parental authority established with respect to the other parent.
    • Copy authenticated by notary of MIGRATION of the departure or death certificate of the other parent in the event that it is registered before a foreign authority; if it is registered in the RENIEC, a simple copy of the death certificate is presented.

    d) Documentary formalities

    Any document that was issued or certified abroad must be apostilled or legalized by the consular offices of Peru and by Foreign Affairs.

    If they are written in a foreign language, they must be translated into Spanish by a sworn public translator or certified translator in Peru. If the translation was carried out abroad, it must contain the same legalizations or apostille of the translated document.

    The immigration authorities will exempt from this provision in special cases duly motivated.

    In the case of children and adolescents of Peruvian or foreign nationality with legal residence or in process and those who, without being so, are found to reside in the country, they will require express authorization from their legal representatives, through the presentation of a Notarial Authorization , the signature of the notary and the signature of the parent who is not accompanying you or, if you are traveling with a third party, the signature of both parents. This authorization is valid for 90 days and must be delivered to the Peruvian immigration authority to allow the minor to leave the country and is valid only once.
