During the state of emergency that was experienced by the COVID-19 pandemic in Peru, the Government ordered a series of measures and recommendations at the national level, the same ones that have been without effect since October 27, 2022, as established in Supreme Decree No. 130-2022-PCM .

This new provision indicates that local, regional and national governments must promote the optional use of masks, vaccination and other measures to promote healthy practices ; all this in coordination with the Ministry of Health .

Admission of Venezuelan people without a visa:

By virtue of the Resolution of the National Superintendence of Migrations, Resolution of Superintendency No. 000177-2019, "it corresponds to admit Venezuelan nationals who, for humanitarian reasons, need to enter the national territory with an identity card and without a passport, being the beneficiaries of this decision the following persons: (i) minors in transit to Peru to meet their parents and do not have an identity card or passport but only a birth certificate, (ii) adults in transit to Peru to meet with their family nucleus residing in Peru, (iii) adults in a situation of extreme vulnerability in transit to Peru, (iv) pregnant women in a situation of extreme vulnerability in transit to Peru; and, (v) older adults, over 60 years of age, in transit to Peru.


Boys, girls and adolescents

Airway

Peruvians, resident foreigners, and non-resident foreigners 12 years of age or older must prove (showing the physical or digital certificate) that they have completed the vaccination schedule against COVID-19 (two doses or Janssen's single dose) in the Peru or abroad. Otherwise, a negative molecular test (PCR) can be presented with a result date that is not more than 48 hours before the boarding time at its point of origin.

Children under 12 years of age only need to be asymptomatic at the time of boarding.

Every person has the right to free access to health benefits according to the General Health Law (Art. 1). Migrants, regardless of their immigration status, can access medical care in public and private establishments. People who do not have health insurance must bear the cost of their care at the health facility of their choice.

It can be requested by foreigners who are in Peru, and who correspond to the nationalities that are members of the Mercosur International Agreement. (Brazil, Colombia, Ecuador, Bolivia, Chile, Argentina, Uruguay and Paraguay).

Applicants who do not file a permanent residence procedure with the National Immigration Superintendence after the expiration of their temporary residence (two years) will be subject to Peruvian immigration legislation.

About permanent residence :

  • Purpose: to obtain an indefinite residence, by virtue of what is established in the Mercosur International Agreement.
  • It allows: to work, study, open bank accounts, access health services, create a company, obtain the single taxpayer registry (RUC), request a driver's license, access social programs and services, among others.

Requirements:

  1. Immigration Status Change Form .
  2. Payment receipt for S/. 162.50 to code 07568
  3. Simple copy of the current passport or identity card or certificate of nationality.
  4. Sworn statement not to record judicial and/or criminal and/or police records in Peru.
  5. Prove that there are lawful livelihoods that allow the subsistence of the petitioner and his cohabiting family group.

Important:

  • The procedure is personal and does not admit the intervention of a proxy.
  • The application must be submitted within 90 days prior to the expiration of the temporary residence.
  • It is necessary to have current temporary residence, obtained in accordance with the terms of the Mercosur agreement, at the time of submitting the application.
  • In the case of minors, they must appear in the company of their father, mother or guardian, and present the requirements stipulated in article 56-C of the Regulation of Legislative Decree No. 1350/2017 .

  • Birth certificate (in case of being a minor) or verification of the person's marital status and nationalization or naturalization certificate, when applicable
  • Certificate of not registering judicial and/or criminal and/or police records in the country of origin or in which you have resided during the five (05) years prior to your arrival in Peru.
  • Sworn statement not to record criminal, judicial and police records at the international level or alerts registered in the INTERPOL system.

Important:

The procedure is personal and does not admit the intervention of a proxy.

In the case of minors, they must appear in person accompanied by their father, mother or guardian, submit a sworn declaration of conformity and submit the requirements stipulated in article 56-C of the Regulations of Legislative Decree No. 1350 and amendments.

Processing time: 30 business days.

Regularization

Regularization - Mercosur

All people in an irregular migration situation will be able to gain regularity.

An irregular migration situation is understood as:

  • the foreign person has expired the period of permanence corresponding to the migratory status assigned by the migratory authority and remains in the national territory.
  • when the foreign person has entered the national territory without having carried out immigration control.

These are the steps you must follow:

  • Request a Temporary Stay Permit Card (CPP), a document issued by the National Immigration Service, valid for 1 year, non-renewable.
  • And before your CPP expires, you must choose one of the immigration statuses established in current immigration regulations.

Once you have the regularization, you can request your change of migratory status by Mercosur Agreement through the digital agency of the National Superintendence of Migration.

Regularization - Other nationalities

An irregular migratory situation is understood when:

  • the foreign person has expired the period of permanence corresponding to the Immigration Status assigned by the Immigration Authority and remains in the national territory.
  • when the foreigner has entered the national territory without having carried out immigration control.

In both cases, the Regulations of the New Migration Law stipulate a regularization process; however, this does not happen indiscriminately or as a common practice. The regulations must be understood when the foreign person is in a situation of vulnerability or proven extreme vulnerability; in these cases, you must start the process with the Vulnerability Office of the central headquarters or by means of a written request in the decentralized zonal offices.

Any foreign person who wishes to regularize their situation in Peru may obtain a foreigner's card requesting residence due to a change in immigration status.

This is the document that accredits the foreign person as a resident of Peru and is valid for 4 years if the person is of legal age, while for minors it lasts 3 years. In the Permanent Immigration Status, the validity can last 5 years.

Conditions

  • Being a foreign citizen with Immigration Status of Resident.
  • Being in national territory.

It is necessary to make the payment of S/ 49.90 to the Banco de la Nación for your right to manage the procedure.

Once you have the Immigration Status of Resident and after payment of S/ 49.90 to the Banco de la Nación or on the payment platform , you must request your registration in the Central Registry of Immigration to the National Superintendence of Migration , virtually. This procedure allows you to request the issuance of your Immigration Card.

1. Resident worker

  • Purpose: Obtain residence with Migratory Status of Worker for three hundred and sixty-five (365) days, to carry out lucrative activities in a subordinate or independent manner.
  • It allows: to work, study, open bank accounts, access health services, create a company, obtain the single taxpayer registry (RUC), request a driver's license, access social programs and services, among others.

Requirements

  • Form (free) that can be obtained on the website www.migraciones.gob.pe or at the National Migration Superintendence – MIGRATIONS.
  • Payment receipt for S/. 162.50 to code 07568.
  • Simple copy of the current passport or valid analogous travel document, when the latter is recognized by Peru as a travel document.
  • International Exchange Card issued by the OCN INTERPOL - Lima of the National Police of Peru with an issue date of no more than six months.
  • Document issued by a competent authority that proves not to record judicial, criminal and police records in the country of origin or in which the applicant would have resided for the period of five years prior to his arrival in the national territory.
  • Sworn statement of the legal representative of the contracting party, stating their names and surnames. Likewise, in the event that the person signing the contract has a position other than that of General Manager, indicate the entry number and registration entry where it is specified that they have the power to hire personnel.

In the case of Dependent Worker:

  • Simple copy of the employment contract, dated no more than thirty (30) calendar days after the issuance of the current document approved by the administrative labor authority, except for the exceptions provided by Law, specifying the term of the contract equal to or greater than ( 1 year.
  • In case of administrative relationship, present the current employment contract in a simple copy that specifies the term of the contract equal to or greater than one year. In case this does not imply the conclusion of an employment contract, you must present a simple copy of the administrative resolution that proves the employment relationship, specifying the work term equal to or greater than one (1) year.

For the case of Independent Worker

  • Simple copy of the contract for the provision of services, indicating the duration of the service equal to or greater than one (1) year.

Important:

  • The procedure is personal and does not admit the intervention of a proxy.
  • In the case of a worker, if the contract has been signed in the national territory, the beneficiary must meet the migratory status enabled or have the authorization to sign documents. Likewise, the presentation of the contract must be no older than thirty business days after being approved by the labor authority, the latter case does not apply to independent workers.
  • In the event that the contract contemplates trial periods or the term is less than one (1) year, its evaluation corresponds as an administrative procedure for the application of Temporary Worker migratory status.
  • The contracting entity must be active and registered with the National Superintendence of Customs and Tax Administration - SUNAT.

2. Resident training

  • Purpose: to obtain a residence with Immigration Quality of Training, granting a period of permanence of 365 days, in order to develop regular studies of basic, higher education, arts or trades, in institutions recognized by the Peruvian State.
  • It allows: studying, opening bank accounts, accessing health services, requesting a driving license.

Requirements:

  • Form (free) that can be obtained on the website www.migraciones.gob.pe or at the National Migration Superintendence – MIGRATIONS.
  • Payment receipt for S/. 162.50 to code 07568.
  • Simple copy of the valid passport or valid analogous travel document.
  • Judicial, criminal and police records of the country of origin (Only adults).
  • Interpol Exchange Form (Only adults).
  • Simple copy of the document that certifies the respective training modality, not older than thirty calendar days.
  • Sworn statement of economic solvency of the applicant for the duration of the migratory status.

2. Resident relative

  • Purpose: Maintain proven family ties with nationals or with foreign residents with current residence in Peru.
  • It allows: to work, study, open bank accounts, access health services, create a company, obtain the single taxpayer registry (RUC), request a driver's license, access social programs and services, among others.

Requirements:

  • Form (free) that can be obtained on the website www.migraciones.gob.pe or at the National Migration Superintendence – MIGRATIONS.
  • Payment receipt for S/. 162.50 to code 07568.
  • Simple copy of the valid passport or valid analogous travel document.
  • Judicial, criminal and police records of the country of origin.
